1. Who provides SafelyShare
These Terms govern the agreement between you and the SafelyShare provider identified below:

2. The service and your account
SafelyShare encrypts selected files in the mobile app, transfers encrypted files directly between nearby devices, and stores the metadata and wrapped key needed to operate a user-configured timelock. SafelyShare does not detect death or incapacity and does not store your safe files on its application server.
You must be at least 16 to create an account or join a Family. Every subscription purchaser and Family owner must be at least 18; parental or guardian permission is not an exception. Registration asks you to confirm these age rules. Keep credentials secure, provide accurate information, and verify your email before purchasing or using Family features. You retain rights in your content and may not use SafelyShare for unlawful or harmful content, infringement, unauthorized access, disruption, or automated abuse.
3. Timelocks
You choose each timelock and remain responsible for extending it. If it expires, the wrapped key is automatically and irreversibly released to the recipient. Automatic extension depends on an active Pro entitlement, your settings, device activity, connectivity, and normal service operation; it is not a guarantee that a safe will remain locked.
4. Plans and prices
- Free: up to two safes and manual timelock extension.
- Individual Yearly: €9.99 per year including applicable VAT, for one Pro account.
- Family Yearly: €29.99 per year including applicable VAT, for six accounts in total, including the purchaser.
Website purchases use Mollie. Mobile purchases use Apple App Store or Google Play billing. Storefront prices and currencies may differ; the price displayed by the store before confirmation controls that purchase. Mobile apps do not offer or link to Mollie checkout.
5. Free trials
Eligible new Individual and Family subscribers receive one free calendar month. Eligibility is determined separately by Mollie for the SafelyShare billing account and by Apple or Google for the relevant store account. A person may therefore have different eligibility with different providers.
Mollie trials require card or PayPal. Due to technical limitations, the trial is unavailable with iDEAL; an iDEAL purchase starts the paid yearly term immediately. Unless cancelled before the displayed conversion date, a trial converts automatically at the displayed annual price. An Individual-to-Family upgrade during a trial keeps the original trial end date and does not create a second trial.
6. Renewal, cancellation, withdrawal, and refunds
The first paid term lasts one year. Unless cancelled, the subscription then continues automatically. For Dutch consumers, after that first fixed term the renewed agreement may be cancelled at any time with no more than one month's notice; unused prepaid renewal time is refunded pro rata. During the initial fixed term, voluntary cancellation normally stops the next renewal and access continues through the paid period without a partial refund. Mandatory consumer rights, approved support exceptions, and provider refund rules always remain available.
Consumers normally have a statutory 14-day right to withdraw from an online subscription. The checkout and durable confirmation explain how to use it, including the online withdrawal function and model form. If you expressly request immediate performance of a paid service and then withdraw, applicable law may allow a proportional charge for service already supplied.
Cancellation never starts a billing-failure grace period. Mollie subscriptions can be cancelled through SafelyShare. Apple and Google subscriptions must be managed through the purchasing store account. Deleting a SafelyShare account does not itself cancel an Apple or Google subscription; cancel it in the store first.
7. Failed-renewal grace
If an automatic renewal or the first charge after a trial fails, Pro remains active until one calendar month after the failed renewal time. The same grace applies to every accepted Family member and includes any provider retry or grace time rather than stacking after it. Successful recovery continues Pro automatically.
No grace applies to manual cancellation, refund, chargeback, revoked purchase, or fraud. When grace expires unpaid, Pro and automatic extension are disabled. The mobile app preserves extension choices only in an encrypted device-local file protected by an account/device key and tries to restore them when Pro returns. Recovery works only on the same app installation and device; after reinstalling, clearing app data, or changing devices, the app can no longer access or decrypt the recovery file.
8. Upgrades
A Mollie Individual-to-Family upgrade charges €20 multiplied by the exact unused fraction of the current annual term, rounded to euro cents, and keeps the renewal date. The exact charge is shown before confirmation. If payment fails, no upgrade is applied. Apple and Google calculate charges, credits, and renewal dates under their store rules; the store confirmation controls.
9. Families
A Family has at most six accepted or reserved seats. Pending invitations reserve seats, expire after seven days, and can be revoked or resent. Invitations are limited to existing accounts with verified matching email addresses. Accepted members receive Pro immediately, including during trial and grace.
Family membership shares only Pro entitlement—not safes, files, keys, recipients, or activity. Members see names and roles; owners also see email addresses and pending invitations. Owners can invite or remove members and appoint or demote owners, but at least one owner must remain. Appointing an owner grants substantial management authority.
All owners may manage a Mollie-billed Family subscription. For Apple or Google, only the purchasing store account can open provider billing controls; other owners see status and store-management instructions. The store purchaser cannot be removed or demoted while that subscription remains active. A removed or departing member loses Family Pro immediately, but personal data and safes are untouched.
An invited user with an Individual subscription must disable its renewal before accepting. Overlapping paid time is not refunded solely because Family access begins. A Family-to-Individual downgrade takes effect at renewal; the purchaser keeps Individual Pro and other members lose Family Pro then.
10. Account deletion
For a Mollie subscription, account deletion cancels renewal and then removes active account data and owned safes immediately, subject to records retained by law, for security, or for legal claims. The same immediate deletion is available when a former Apple or Google subscription is inactive. An active Store purchaser must first cancel through Apple or Google and wait until that Store subscription is no longer active before deleting the purchaser account. Other eligible Family-account deletions do not alter personal data or safes belonging to remaining members.
11. Service standards and liability
Mandatory legal rights for digital services, including conformity, security updates, remedies, and liability, are not excluded. SafelyShare is not responsible for loss caused solely by a user-selected expiry or a key release that occurred correctly under the configured timelock. Nothing in these Terms excludes liability that cannot legally be excluded.
12. Changes, suspension, and termination
Material changes are notified in advance on a durable medium when required and include any applicable right to cancel. Continued use alone does not waive mandatory rights. SafelyShare may proportionately suspend access for abuse, security threats, or material breach, while preserving mandatory remedies and already-accrued rights.
13. Law and contact
The governing-law clause and competent-court wording require counsel review after the legal entity and target markets are confirmed.
