Terms of Service

1. Acceptance of Terms

By accessing or using SafelyShare ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

SafelyShare is a digital safe service that enables users to encrypt selected files (photos, videos, and documents) in the app and share them with designated recipients. The Service uses a time-locked key release process based on user-configured intervals.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Regularly extending your timelocks if you wish to keep your safes locked
  • Ensuring the content you store complies with applicable laws

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this requirement.

4. How the Timelock Works

When you create a safe, you set a timelock interval. The safe remains locked as long as you extend the timelock before it expires. If the timelock expires without extension:

  • The encrypted access key stored on our servers is released to the designated recipient
  • The recipient can use this key to decrypt the safe contents on their device
  • This process is automatic and irreversible once the key has been released

It is your responsibility to extend your timelocks. Reminder delivery is coming soon and is not currently available, so you should manage timelocks directly in the application.

5. Plans

Free Plan

The currently available Free plan includes up to 2 safes and manual timelock extension at no cost.

Planned Pro Plan

Paid Pro plans are coming soon and cannot currently be purchased. Planned features and prices may change before launch.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

  • Safe files are encrypted in the app before local transfer to the recipient's device
  • The service stores account, device, subscription, and safe metadata, plus the recipient public key and wrapped safe key
  • The SafelyShare application server is not used to store safe files
  • You retain all rights to the content you store in your safes

7. Prohibited Uses

You may not use the Service to:

  • Store or transmit content that is illegal, harmful, or infringes on others' rights
  • Attempt to reverse-engineer, decompile, or exploit the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Create accounts through automated means or use the Service for unauthorized commercial purposes

8. Limitation of Liability

To the maximum extent permitted by law, SafelyShare and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data resulting from the use or inability to use the Service
  • Unauthorized access to your transmissions or data
  • The release of encryption keys due to expired timelocks, as this is a core function of the Service

Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

10. Modifications

We may modify these Terms from time to time. We will update the date on this page and provide additional notice when required. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
